Introduction

This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. For the purpose of the Data Protection Act 2018 (the “Act”), the data controller is Swifex Ltd (company number 10538602).

Information that we collect

Swifex processes your personal information to meet our legal, statutory and contractual obligations and to provide you with our products and services. Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together follows:

  • Identity data includes first name, maiden name, last name, title and date of birth as well as KYC data such as passports, driving licenses and utility bills.

  • Contact data includes email address, home address and telephone numbers.

  • Transaction data includes details about payments or card transactions made using our services.

  • Technical data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.

  • Usage data includes information about how you use our website and services.

  • Marketing and communications data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

Disclosure of your information

Where we store your personal data

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. All information you provide to us is stored on our secure servers. Any payment transfers will be encrypted using SSL technology. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential.  We ask you not to share a password with anyone.

 

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site: any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try and prevent unauthorised access.

 

How long we keep your data

We are required under UK tax law to keep your basic personal data (name, address, contact details) for a minimum of 6 years after you cease being a client. Where you have consented to us using your details for direct marketing, we will keep such data until you notify us otherwise and/or withdraw your consent.

Your rights

You have the right to view any personal information that Swifex holds about you, including:

  • Personal data we hold about you

  • The purposes of the processing

  • The categories of personal data concerned

  • The recipients to whom the personal data has/will be disclosed

  • How long we intend to store your personal data for

  • If we did not collect the data directly from you, information about the source

If you believe that we hold any incomplete or inaccurate data about you, you have the right to ask us to correct and/or complete the information and we will strive to do so as quickly as possible; unless there is a valid reason for not doing so, at which point you will be notified.

You also have the right to request erasure of your personal data or to restrict processing (where applicable) in accordance with the data protection laws; as well as to object to any direct marketing from us. Where applicable, you have the right to data portability of your information and the right to be informed about any automated decision-making we may use.

 

If you wish to exercise any of your rights as detailed above, please send an email to support@swifex.com with “Data Protection Officer” in the subject line.

If we receive a request from you to exercise any of the above rights, we may ask you to verify your identity before acting on the request; this is to ensure that your data is protected and kept secure.  In most cases, exercising your rights will be free of charge and must be provided within one month of receipt.

Consequences of not providing your data

You are not obligated to provide your personal information to Swifex, however, as this information is required for us to provide you with many of our services, we may not be able to offer some/all our services without it.
